Misechko & Partners secured recognition in Slovakia of a MAC award at the Ukrainian Chamber of Commerce and Industry
Misechko & Partners represented PJSC “Ukrainian Danube Shipping Company” in the Slovak Republic in matters related to the recognition in Slovakia of an award rendered by the Maritime Arbitration Commission at the Ukrainian Chamber of Commerce and Industry.
By the said award, the Maritime Arbitration Commission at the UCCI upheld the claims of PJSC “Ukrainian Danube Shipping Company” against AV Parko (Slovakia) and ordered the recovery of EUR 75,000.
In accordance with the Convention on the Recognition and Enforcement of Foreign Arbitral Awards (New York, 1958), to which both Ukraine and the Slovak Republic are parties, foreign arbitral awards are subject to recognition and enforcement in the territories of contracting states upon application of an interested party.
A specific feature of the Slovak legal framework is that recognition of a foreign arbitral award is considered by the court within enforcement proceedings, after which a judicial bailiff is appointed to carry out enforcement measures.
