Misechko & Partners successfully represented a Ukrainian company in CIETAC arbitration against a Chinese supplier
Misechko & Partners successfully represented the interests of the Ukrainian company Energy Hub in an international arbitration dispute against the Chinese company Inner Mongolia Pulis Chemical Co., Ltd. before the Shanghai Sub-Commission of the China International Economic and Trade Arbitration Commission (CIETAC).
The dispute arose from the Chinese supplier’s failure to perform its obligations under an international supply contract. Despite having received full payment for the goods, the respondent neither delivered the goods nor refunded the funds received.
During the proceedings, the arbitral tribunal confirmed the validity of the contract, established that the respondent had received the payment, and concluded that the Chinese company had committed a fundamental breach of its contractual obligations.
As a result, the arbitral tribunal rendered an award in favor of the Ukrainian company and ordered Inner Mongolia Pulis Chemical Co., Ltd. to reimburse the advance payment, compensate legal and translation costs, and reimburse the arbitration fees incurred by the claimant.
The arbitral award is final and binding upon the parties from the date of its issuance.
