The Decision of the Embassy of Ukraine in the Republic of Latvia on citizenship annulment cancelled in the court
On April 15, 2024, after more than three years from the moment of filed our claim to court, the Kyiv District Administrative Court issued a significant ruling in the case filed by the client of Misechko & Partners Law Firm against the Embassy of Ukraine in the Republic of Latvia and the Ministry of Foreign Affairs of Ukraine to canceling the decision on annulment of Ukrainian citizenship.
The client of Misechko & Partners Law Firm received Ukrainian citizenship in December 2017 based on territorial origin, with the certificate of registration as a Ukrainian citizen issued by the Embassy of Ukraine in the Republic of Latvia.
In December 2019, the client received a notification from the Consular Section of the Embassy of Ukraine in the Republic of Latvia about the annulment of his Ukrainian citizenship due to the non-submission of a renunciation of other citizenship, with this decision being made before the end of the allotted two-year period for such renunciation.
The Kyiv District Administrative Court, in its ruling to satisfy the claim, stated that a necessary and mandatory condition for canceling the decision on the acquisition of Ukrainian citizenship is the establishment by the central executive body implementing state policy in the field of citizenship, of the fact that the person acquired Ukrainian citizenship through fraud, by providing knowingly false information or forged documents, or concealing any significant fact that would prevent the person from acquiring Ukrainian citizenship. However, the Embassy of Ukraine in the Republic of Latvia did not provide any evidence of the plaintiff's wrongdoing, which became the basis for satisfying the claim.
