Obtaining a temporary residence permit on the basis of employment

Foreign nationals and stateless persons may obtain a temporary residence permit in Ukraine on the basis of a work permit.
 
For this purpose, a foreign national may be employed by an already registered Ukrainian company or establish their own limited liability company in Ukraine and, after obtaining a work permit, assume the position of director.
 
Ukrainian law does not establish a mandatory requirement to pay a foreign employee a salary equal to 5 or 10 minimum wages. The foreign employee’s terms of remuneration must comply with Ukrainian law and may not be less favourable than those applicable to Ukrainian citizens in a comparable position.

I. Obtaining a Taxpayer Identification Number
A taxpayer identification number is required for a foreign national, including for the registration of a company, employment and obtaining a residence permit.
 
Required documents
  1. A notarised copy of the foreign national’s passport document.
  2. A notarised power of attorney for the representative.
 
Estimated processing time — 1 business day.
 
II. Registration of a Company in Ukraine
If a foreign national intends to establish their own business in Ukraine, we can provide full legal support for the registration of a limited liability company.
 
For the registration, the following should be determined:
  • the name of the limited liability company;
  • the legal address;
  • the amount of the share capital;
  • the types of economic activities;
  • the director of the company.
At the time of registration, the director of the company must be a Ukrainian citizen or a foreign national who already holds a work permit in Ukraine. After obtaining a work permit, the foreign founder may be appointed as the director of the company.
 
Required documents
  • a copy of the passport and taxpayer identification number of the director;
  • a notarised copy of the passport document of the foreign founder;
  • the taxpayer identification number of the founder;
  • a notarised power of attorney for the representative to register the company.
If the founder of the Ukrainian company is a foreign legal entity, the following documents may additionally be required:
  • a resolution of the competent body of the foreign legal entity on the establishment of a company in Ukraine;
  • a power of attorney for the representative;
  • an extract from the commercial, banking or other official register of the country of registration;
  • documents confirming the ownership structure and ultimate beneficial owners;
  • other documents, depending on the country of registration and the company’s structure.
Estimated registration time for a limited liability company — 1 business day after preparation and submission of all required documents.
 
III. Obtaining a Work Permit for a Foreign National
A work permit for a foreign national is obtained by the employer from the relevant regional employment centre.
 
Required documents
  • an application in the prescribed form;
  • copies of the passport pages containing the foreign national’s personal data, together with a duly certified Ukrainian translation;
  • a colour photograph measuring 3.5 × 4.5 cm;
  • a draft employment agreement or contract with the foreign national, certified by the employer.
For most categories of employees, the work permit is issued for the term of the employment agreement, but for no more than two years. Upon expiry, its validity may be extended.
 
The application for the issuance of a work permit is considered within up to 7 business days.
 
The amount of the state fee depends on the period for which the work permit is issued and is determined by legislation in force on the date of submission.
 
IV. Obtaining a Long-Term Type D Visa
After obtaining a work permit, a foreign national who requires a visa to enter Ukraine must obtain a long-term type D visa.
 
A type D visa is generally issued for up to 90 days and serves as the basis for submitting documents for a temporary residence permit in Ukraine.
 
An application for a type D visa must be submitted to a Ukrainian diplomatic mission or consular office outside Ukraine. It is not possible to apply for such a visa within Ukraine.
 
Citizens of countries for which Ukrainian law or international treaties provide for visa-free entry may apply for a residence permit without obtaining a type D visa.
 
Main documents for a type D visa
  • visa application form;
  • passport document of the foreign national;
  • colour photograph;
  • valid medical insurance policy;
  • document confirming payment of the consular fee;
  • certified copy of the work permit;
  • other documents that may be required by the relevant Ukrainian diplomatic mission or consular office.
The processing time for a visa application is usually up to 10 business days, or up to 5 business days under the expedited procedure.
 
V. Obtaining a Temporary Residence Permit
Documents for a temporary residence permit must be submitted personally by the foreign national to the relevant territorial unit of the State Migration Service of Ukraine, an authorised state enterprise or an administrative service centre, depending on the place of residence and the availability of the relevant service.
 
Required documents
  • a valid passport document of the foreign national with a type D visa, if such visa is required;
  • a copy of the passport page containing the type D visa, where applicable;
  • a duly certified Ukrainian translation of the passport page containing the foreign national’s personal data;
  • the work permit;
  • the employer’s undertaking to notify the State Migration Service of Ukraine and the State Employment Service of the early termination or cancellation of the employment agreement with the foreign national;
  • a valid medical insurance policy covering the entire period of validity of the residence permit;
  • a document confirming payment of the administrative fee.
The temporary residence permit is issued for the period of validity of the work permit.
 
Documents for a temporary residence permit must be submitted no later than 15 business days before the expiry of the permitted period of stay in Ukraine.
 
VI. Registration of the Place of Residence
After obtaining a temporary residence permit, the foreign national must register their place of residence in Ukraine within 30 calendar days.
 
Registration requires the consent of the owner of the accommodation or documents confirming the right to use the accommodation.
 
Important
Documents issued outside Ukraine must be apostilled or legalised, unless otherwise provided by an international treaty of Ukraine. Such documents must also be translated into Ukrainian and duly certified.
 
The list of documents and the procedure may differ depending on the foreign national’s citizenship, the country in which the documents were issued, the company’s ownership structure and the specific circumstances of the case.
 
Legal Fees
The legal fee for obtaining a temporary residence permit on the basis of employment is EUR 2,500.
 
The fee does not include direct expenses, including state fees, consular fees, translation services, notarial services, and costs related to apostille or legalisation of documents.
