Representation before the International Commercial Arbitration Court (ICAC)
The International Commercial Arbitration Court (ICAC) at the Ukrainian Chamber of Commerce and Industry is a permanent arbitral institution located in Kyiv, Ukraine. It operates under the Law of Ukraine "On International Commercial Arbitration" and its own Rules (Regulations).
ICAC functions as an independent arbitral tribunal for resolving cross-border commercial disputes and is the most established forum for international arbitration in Ukraine.
Types of disputes handled by ICAC
According to Article 2 of the ICAC Rules, the court is competent to hear:
-
disputes arising from contractual and other civil-law relationships in the context of international trade, where at least one party is a foreign legal entity or individual;
-
disputes involving enterprises with foreign investments, international organizations or associations operating in Ukraine;
-
disputes between participants of such organizations and third parties.
A valid arbitration agreement or clause is a prerequisite for ICAC jurisdiction.
Key advantages of ICAC arbitration in Ukraine:
-
Shorter timelines compared to state commercial courts;
-
Simplified procedural rules;
-
No appeal or cassation — the award is final and binding;
-
Parties may appoint one or more arbitrators of their choice;
-
Limited grounds for setting aside the award (procedural violations only);
-
Awards may be enforced under the New York Convention.
Arbitration fees
-
Registration fee: USD 600.00
-
Arbitration fee: calculated based on the amount in dispute (see ICAC’s fee calculator).
Once the arbitration fee is paid and the tribunal is constituted, proceedings are conducted in accordance with the ICAC Rules.
